When do you need a solicitor?

In some instances, our lawyers will offer initial advice or point you in the right direction for resolving a matter yourself.  In other cases, we will recommend legal representation.  It all depends on the specific situation you are in and the issues you face.

Firstly, it’s important to understand what area of the law you need assistance with.  

Criminal Law: This is when an allegation has been brought against you in relation to a Local, State or Federal Law, or the government brings a case against you. In these instances, you require a solicitor to defend you in court and to resolve the matter in as short a timeframe as possible so that you can get on with your life.

Civil Law: Civil law issues include circumstances were a law itself hasn’t been broken, but there is nonetheless a legal issue in which one party feels wronged by the other. Civil law has a wide net and includes areas such contract law, divorces, defamation, damages, and other areas where one person might sue another, or a corporation. You may need to speak to a solicitor to resolve the issues or to prepare legal documents, depending on the circumstances. 

Commercial Law:  These issues include matters dealing with directors’ duties, company set up, partnership matters, shareholder agreements, or circumstances where a business or company requires advice on legal matters.

Employment Law: This includes issues concerning both the employer and employee, mediation for an employment contract, drafting employment contracts or investigation of employee conduct.

Liquor Licensing: includes matters dealing with licensed premises and non-licensed premises and may include council applications, or applications for a liquor license.  There are circumstances where a law has not been broken but there is a need for specialised knowledge and experience in dealing with different organisations namely, Licensing Police, Councils, Liquor and Gaming NSW and other organisations.  Assistance may also be required with gaming machine applications and Registered Clubs matters including investigations and club governance.

When a solicitor is essential
